La trasmigrazione del giudizio ex art. 573, comma 1-bis, c.p.p.: dubbi di legittimità costituzionale o meri problemi applicativi?
ABSTRACT: Il contributo analizza la recente ordinanza di rimessione alla Corte costituzionale, sollevata dalla Terza Sezione civile della Corte di cassazione, che dubita della legittimità dell’art. 573, comma 1-bis, c.p.p., evidenziando non solo le debolezze delle argomentazioni avanzate, ma dubitando, a monte, della stessa ammissibilità della questione.
ABSTRACT: This paper analyses the recent referral order to the Constitutional Court, issued by the Third civil Section of the Court of Cassation, which questions the constitutionality of Article 573, paragraph 1-bis, of the Code of Criminal Procedure, highlighting not only the weaknesses of the arguments put forward, but also, more fundamentally, casting doubt on the very admissibility of the referral.
